1. Acceptance of Terms
By creating an account or using InspectorData, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use our services.
2. Description of Service
InspectorData provides a software platform for home inspectors that includes:
- Auto-generated inspection report content from uploaded photos
- Automated scheduling and appointment management
- Client relationship management (CRM)
- Digital agreements and e-signatures
- Business analytics and reporting tools
- Comment library and template management
- Mobile inspection capabilities
3. Account Registration
Eligibility
You must be at least 18 years old and authorized to conduct business to use InspectorData. You represent that all information provided during registration is accurate and current.
Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your team members who access your account comply with these terms
4. Beta Access and Service Availability
InspectorData is currently in beta testing. During beta:
- The service is provided "as is" and may contain bugs or errors
- Features may be added, modified, or removed
- Service interruptions may occur for maintenance or improvements
- We welcome your feedback to improve the platform
- Beta users receive free access to premium features
5. User Responsibilities
Acceptable Use
You agree to use InspectorData only for lawful purposes. You will not:
- Upload malicious code, viruses, or harmful content
- Attempt to access other users' accounts or data
- Interfere with or disrupt the service
- Use the service for illegal activities
- Reverse engineer or copy our software
- Share your account credentials with unauthorized parties
- Scrape or extract data through automated means
Professional Standards
You are responsible for:
- The accuracy of inspection reports you generate
- Reviewing and editing AI-generated content before use
- Complying with all applicable inspection standards and regulations
- Maintaining your professional licenses and certifications
- Using our tools as aids, not replacements for professional judgment
6. Auto-Generated Content and Inspector Responsibility
InspectorData provides tools that automatically generate inspection report content based on your uploaded photos and inputs. By using these features, you acknowledge and agree:
- Your Report, Your Responsibility: All content generated by InspectorData, whether auto-generated or manually entered, becomes YOUR inspection report. You are solely responsible for its accuracy, completeness, and compliance with applicable standards.
- Review Required: You MUST review, verify, edit, and approve all auto-generated content before delivering any report to clients. Auto-generated suggestions are starting points only.
- Professional Judgment: Auto-generated content is a tool to assist you, not replace your professional expertise, training, or on-site observations. You are the licensed inspector.
- No Warranty on Generated Content: InspectorData makes no warranty regarding the accuracy, completeness, or suitability of any auto-generated content for your specific inspection.
- Sole Liability: InspectorData shall not be liable for any errors, omissions, or inaccuracies in auto-generated content, or for any claims, damages, or losses arising from your use of such content in inspection reports.
- Acceptance of Responsibility: By delivering any inspection report created using InspectorData, you accept full responsibility for all content contained therein, regardless of how it was generated.
7. Intellectual Property
Our IP
InspectorData owns all rights to:
- The platform software, source code, and underlying technology
- Logos, trademarks, and branding
- Template designs and comment libraries
- Documentation and training materials
Your Content
You retain ownership of:
- Inspection photos and reports you create
- Client data and business information
- Custom comments and notes
You grant us a limited license to process your content to provide our services (e.g., photo analysis for auto-generated comments).
8. Payment and Billing
Beta Pricing
During beta, InspectorData is free to use. Premium features are unlocked at no cost for beta users.
Future Pricing
When we launch commercially:
- Beta users will receive special "founding member" pricing
- You will be notified 30 days before any charges begin
- You may cancel your account before charges take effect
- Pricing will be clearly communicated on our website
Usage Limits and Abuse
Auto-generated comment features are provided for legitimate home inspection report writing. Abuse of these features, including but not limited to:
- Excessive or automated requests beyond normal inspection usage
- Using the service for purposes other than home inspection reports
- Sharing account access to circumvent usage limits
- Any activity that places unreasonable burden on our systems
May result in additional monthly fees, usage restrictions, or account suspension. We reserve the right to implement fair usage policies and charge overage fees for excessive use of auto-generated features.
Payment Processing
When applicable, payments are processed through secure third-party providers (Stripe). By providing payment information, you authorize us to charge your payment method.
9. Data and Privacy
Your use of InspectorData is also governed by our Privacy Policy. Key points:
- Your data is tenant-isolated (separate from other users)
- We use industry-standard security measures
- You can export or delete your data at any time
- We do not sell your personal information
10. Service Modifications
We reserve the right to:
- Modify or discontinue features with reasonable notice
- Update these Terms of Service (we'll notify you of material changes)
- Perform maintenance that may temporarily interrupt service
- Improve and enhance the platform based on user feedback
11. Termination
By You
You may terminate your account at any time by contacting support. Upon termination, you may export your data within 30 days.
By Us
We may suspend or terminate your account if:
- You violate these Terms of Service
- You engage in fraudulent or illegal activities
- Your account poses a security risk
- You fail to pay fees when applicable
We will provide reasonable notice unless immediate termination is required for security or legal reasons.
12. Disclaimers and Limitations of Liability
Service Warranty
InspectorData is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee:
- Uninterrupted or error-free service
- Complete accuracy of auto-generated content
- Compatibility with all devices or browsers
- Specific results from using the platform
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSPECTORDATA AND ITS FOUNDERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages resulting from your use of auto-generated content in inspection reports
- Claims arising from your inspection services or reports
- Third-party actions or content
- False representation or unauthorized access to data
INSPECTORDATA'S SOLE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL BE LIMITED TO A REFUND OF AMOUNTS PAID BY YOU TO INSPECTORDATA DURING THE PRIOR TWELVE (12) MONTHS, OR TERMINATION OF YOUR ACCOUNT.
13. Indemnification
You agree to indemnify and hold InspectorData and its officers, directors, employees, affiliates, and successors harmless from any claims, demands, suits, damages, or expenses (including reasonable attorneys' fees) arising from:
- Your use of InspectorData, including any auto-generated content
- Your inspection reports and professional services
- Your violation of these Terms of Service
- Your violation of any law or third-party rights
- Any claims by your clients or third parties related to inspections performed using InspectorData
14. Professional Licensing
InspectorData is a tool for licensed home inspectors. You represent that:
- You hold all necessary licenses and certifications
- You comply with your jurisdiction's inspection standards
- You maintain appropriate professional liability insurance
- You understand our platform assists, but does not replace, professional expertise
15. Third-Party Services
Our platform may integrate with third-party services (payment processors, mapping services, etc.). Your use of these services is subject to their terms and conditions.
16. Dispute Resolution
If you have a dispute with InspectorData:
- Contact us first at support@inspectordata.com to resolve informally
- If unresolved, disputes will be governed by the laws of [Your State/Country]
- Both parties agree to binding arbitration for disputes exceeding $10,000
17. Governing Law
These Terms are governed by the laws of the United States and the state in which InspectorData operates, without regard to conflict of law principles.
18. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and InspectorData.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
